2. PURPOSE OF THE SITE

The SARL LCM website (hereinafter the "Site") is an e-commerce site offering bakery and pastry products for sale.
This Site is accessible via the Internet at www.mokka-strasbourg.fr on all compatible devices. 

3. PERSONAL DATA AND COOKIES

SARL LCM collects personal data within the framework of this Site. The provisions relating to the processing of this data are set out in the "Data protection policy" of this Site. 

4. INTELLECTUAL PROPERTY

4.1. Website

The Site and any software necessarily used in connection with it may contain confidential information and data protected by intellectual property law. Thus, unless otherwise stated, intellectual property rights on documents and data of any kind contained on the Site and each of the elements making up the Site (images, illustrations, sounds, texts, graphic elements, charter, etc.), including software, databases and newsletters, are the exclusive property of SARL LCM (hereinafter the "Content"), which does not grant any license or right other than that of consulting the Site. Reproduction of all or part of the Content is authorized solely for the purposes of information for personal and private use, any reproduction and any use of copies made for other purposes in any manner whatsoever and in any form whatsoever being expressly prohibited. It is also forbidden to copy, modify, create a derivative work of, assemble, decompile (except as provided by law), sell, assign, sublicense or transfer in any way whatsoever any right pertaining to the Content. It is also forbidden to modify all or part of the Content, and in particular the software, or to use modified versions of the software, with a view in particular to obtaining unauthorized access to the service and to accessing the Site.

4.2 Brands

Please note that SARL LCM is the owner of the MOKKA brand and its logos.

The Internet user acknowledges SARL LCM's exclusive rights to MOKKA and undertakes not to use it in any way whatsoever or, more generally, to infringe any intellectual property rights. SARL LCM reserves the right to claim damages in the event of counterfeiting and, more generally, infringement of its intellectual property rights. Likewise, the Visitor agrees not to infringe any property rights, in particular intellectual property rights.

5. VISITOR BEHAVIOR

Each Visitor must use the Internet responsibly, with respect and courtesy towards the rights of other Internet users.

In this respect, the Visitor, when accessing the Site, agrees in particular not to:

- upload to the Site, post, e-mail or otherwise transmit any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, including rights of publicity, invasive of another's image, hateful, derogatory or racially, ethnically or otherwise objectionable;

- upload to the Site, post, email or otherwise transmit unsolicited or unauthorized advertising or promotional materials, "junk mail," "misleading information," "chain letters," or any other form of solicitation;

- upload to the Site, post, email or otherwise transmit any material that contains software viruses or other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

- disrupt or interrupt the Site or the servers or networks connected to the Site, or violate the requirements, procedures, rules or regulations of the networks connected to the Site;

- attempt to interfere with the service of any user, host or network, including, but not limited to, exposing the Site to a virus, creating a flood, flooding the server, overloading the e-mail system, or forging any TCP/IP packet header information or any part of the header information in any e-mail;

- access data not intended for the Visitor or enter a server/account to which the Visitor is not authorized to have access;

- attempt to probe, scan or test the vulnerability of a system or network, or to breach security or authentication measures without authorization;

- impersonate another person;

- carry out an activity or incite a third party to carry out an illegal activity or any other activity that would infringe the rights of SARL LCM, its suppliers, partners, distributors, advertisers or any other Visitor;

- transmit or transfer (by any means whatsoever) any information or software derived from the Site, in particular to other countries or to certain foreign nationals in violation of any national or international law or regulation.

Recognizing the global nature of the Internet, each Visitor agrees to abide by all local and international rules and procedures regarding online behavior and acceptable content, and in particular all applicable laws regarding the transmission of technical data.

At any time and for any reason whatsoever, SARL LCM may implement any means allowing it to terminate, without notice, the Visitor's use of the Site or any of the services for any conduct violating these terms of use, without prejudice to any damages that SARL LCM reserves the right to claim from the Visitor in the event of non-compliance with the site's general terms of use.

6. LIABILITY

6.1. Site access and operation

The Visitor is personally responsible for setting up the computer and telecommunications resources needed to access the Site and for acquiring the knowledge required to use the Internet and access the Site. The Visitor shall bear the connection and equipment costs associated with Internet access and use of the Site.

Visitors use the Site at their own risk. SARL LCM shall therefore not be held liable for any damage that any Visitor may suffer as a result of such use. Furthermore, SARL LCM DISCLAIMS ALL RESPONSIBILITY FOR INDIRECT DAMAGES, WHATEVER THE CAUSE, ORIGIN, NATURE OR CONSEQUENCE, INCLUDING IN PARTICULAR THE COSTS WHICH MAY ARISE FROM THE PURCHASE OF GOODS OFFERED ON THE SITE.

7. GENERAL

7.1. Modifications

SARL LCM reserves the right to modify and update the General Conditions of Use without prior notice. In order to be informed of any such modifications, SARL LCM advises the Visitor to reread the GTC regularly. Use of the Site will be subject to the GTC in force at the time of use.

7.2 Completeness

In the event that one of the clauses of these General Terms and Conditions should become null and void as a result of a change in legislation, regulations or a court ruling, this shall in no way affect the validity of and compliance with the other clauses of the General Terms and Conditions.

7.3. Applicable law

These terms and conditions are governed by French law.
